ShipDesi – Terms & Conditions

1. Introduction

Welcome to ShipDesi.

These Terms & Conditions ("Terms") govern your access to and use of the ShipDesi platform, website, warehouse services, package forwarding services, personal shopper services, and fulfillment services (collectively, the "Services").

By accessing or using ShipDesi, you agree to be legally bound by these Terms.

If you do not agree with these Terms, you must not use our Services.


2. Definitions

  • "ShipDesi", "Company", "we", "our", or "us" refers to ShipDesi and its affiliated entities.
  • "User", "Customer", or "you" refers to any person or business using our Services.
  • "Warehouse" refers to ShipDesi-operated storage and fulfillment facilities.
  • "Package" refers to any parcel, shipment, product, or inventory handled by ShipDesi.
  • "Personal Shopper Service" refers to the assisted procurement service offered by ShipDesi.
  • "Fulfillment Services" refers to storage, pick-pack-ship, and related logistics services for sellers and businesses.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use ShipDesi.

By using our Services, you represent that:

  • All information provided is accurate and complete.
  • You will comply with all applicable laws and regulations.
  • You will not use ShipDesi for unlawful activities.

4. Nature of Services

ShipDesi operates as:

  • A package forwarding platform
  • A warehousing and logistics service provider
  • A fulfillment and export support platform
  • A personal shopper service provider

ShipDesi is not a courier company and may utilize third-party courier partners including DHL, FedEx, UPS, Garudavega, and others.


5. User Accounts

Users may be required to create an account to access certain Services.

You are responsible for:

  • Maintaining account confidentiality
  • Restricting access to your account
  • All activities conducted under your account

ShipDesi reserves the right to suspend or terminate accounts suspected of fraud, abuse, or illegal activity.


6. Package Forwarding Services

6.1 Virtual Address

ShipDesi may provide customers with a virtual Indian warehouse address for receiving packages.

This address remains the property of ShipDesi and may only be used for lawful purposes.

6.2 Package Handling

ShipDesi may:

  • Receive
  • Inspect externally
  • Photograph
  • Repack
  • Consolidate
  • Store
  • Dispatch

packages on behalf of customers.

ShipDesi reserves the right to refuse or reject any package at its discretion.

6.3 Consolidation

Customers may request consolidation of multiple packages into one shipment.

ShipDesi is not liable for manufacturer packaging removed or discarded during consolidation unless specifically requested otherwise.


7. Personal Shopper Services

7.1 Purchase Requests

Customers may request ShipDesi to purchase products on their behalf.

ShipDesi may:

  • Approve or reject requests
  • Require advance payment
  • Charge service fees

at its discretion.

7.2 Product Availability

ShipDesi does not guarantee:

  • Product availability
  • Seller reliability
  • Product authenticity
  • Product quality

unless explicitly stated.

7.3 Order Cancellation

Once a personal shopper order has been placed with a third-party seller, cancellations may not be possible.

Service fees and transaction fees may be non-refundable.


8. Fulfillment & 3PL Services

8.1 Inventory Ownership

For fulfillment services, customers retain ownership of their inventory unless otherwise agreed in writing.

ShipDesi acts solely as:

  • Warehouse operator
  • Fulfillment provider
  • Logistics facilitator

8.2 Inventory Accuracy

Customers are responsible for:

  • Accurate SKU information
  • Product descriptions
  • Customs declarations
  • Compliance documentation

8.3 Fulfillment Operations

ShipDesi may:

  • Store inventory
  • Pick and pack products
  • Arrange shipping
  • Process fulfillment orders

based on customer instructions.


9. Prohibited Items

Users may not ship, store, purchase, or request handling of prohibited or restricted items, including but not limited to:

  • Illegal drugs or narcotics
  • Weapons or ammunition
  • Explosives
  • Hazardous materials
  • Counterfeit goods
  • Restricted medicines
  • Perishable or banned items
  • Any item prohibited under Indian or destination-country law

ShipDesi reserves the right to dispose of prohibited items without compensation.


10. Customs & Compliance

Customers are solely responsible for:

  • Accurate customs declarations
  • Duties and taxes
  • Import restrictions
  • Compliance with destination-country laws

ShipDesi is not responsible for:

  • Customs delays
  • Seizures
  • Fines
  • Duties imposed by authorities

11. Shipping & Delivery

Estimated delivery timelines are indicative only.

ShipDesi does not guarantee:

  • Delivery dates
  • Courier performance
  • Customs clearance timing

Delays caused by:

  • Couriers
  • Customs authorities
  • Weather
  • Political events
  • Force majeure

are outside ShipDesi's control.


12. Storage Policy

ShipDesi may provide a free storage period as determined by the Company.

After the free storage period expires:

  • Storage charges may apply
  • Unclaimed packages may be disposed of after reasonable notice

ShipDesi reserves the right to determine storage policies at its discretion.


13. Payments & Fees

Customers agree to pay:

  • Shipping charges
  • Service fees
  • Storage fees
  • Customs duties
  • Applicable taxes

All fees are payable in advance unless otherwise agreed.

ShipDesi reserves the right to modify pricing at any time.


14. Refunds

Refunds are issued solely at ShipDesi's discretion.

The following are generally non-refundable:

  • Completed shipping charges
  • Courier fees
  • Customs duties
  • Personal shopper service fees
  • Fulfillment handling fees

Refund processing timelines may vary.


15. Limitation of Liability

To the maximum extent permitted by law:

ShipDesi shall not be liable for:

  • Indirect damages
  • Consequential losses
  • Loss of profit
  • Emotional distress
  • Delayed delivery
  • Customs actions
  • Third-party courier errors

ShipDesi's total liability for any claim shall not exceed the amount paid by the customer for the affected shipment or service.


16. Insurance

Shipping insurance may be available for certain shipments.

Unless insurance is explicitly purchased, shipments are handled at the customer's own risk.


17. Intellectual Property

All content, branding, software, graphics, logos, and materials associated with ShipDesi are the intellectual property of ShipDesi.

Unauthorized use is prohibited.


18. Privacy

By using ShipDesi, you consent to the collection and use of your information in accordance with our Privacy Policy.


19. Suspension & Termination

ShipDesi reserves the right to:

  • Refuse service
  • Suspend accounts
  • Cancel shipments
  • Terminate access

for violations of these Terms or applicable laws.


20. Force Majeure

ShipDesi shall not be liable for failure or delay caused by events beyond reasonable control, including:

  • Natural disasters
  • Government restrictions
  • War
  • Pandemics
  • Strikes
  • Customs actions
  • Carrier disruptions

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the courts located in Kerala, India.


22. Changes to Terms

ShipDesi may update these Terms at any time without prior notice.

Continued use of the Services constitutes acceptance of revised Terms.
